General Terms and Conditions
1. Applicability
All transactions are subject to these terms and conditions unless otherwise agreed upon in writing.
2. Quotation and Agreement
Quotations are based on standard rates. Custom quotes for specific services will be provided and must be approved in writing by the client.
3. Invoicing
Costs will be invoiced afterwards based on actual calculations.
4. Execution of Work
The client must follow RatTech Solutions instructions to ensure smooth execution of the work. Failure to adhere to these instructions may reduce or eliminate RatTech Solutions responsibility.
5. Additional Costs, Extra Work, and Reduced Work
Costs arising from the client’s failure to act will be charged. Additional or reduced work will be adjusted fairly. “Costs arising from the client’s failure to act” refer to all extra expenses incurred due to the client’s non-compliance with the provided instructions.
6. Payment
Payment must be made within 30 days of the invoice date. If this period is exceeded, the standard statutory interest will be due.
7. Complaints
Complaints must be submitted in writing within 8 calendar days of completion. RatTech Solutions will provide a response and a potential solution within 5 business days of receiving the complaint.
8. Non-Compliance and Termination
Non-compliance due to force majeure exempts the party from responsibility. Force majeure includes natural disasters, epidemics, pandemics, government measures, labor disputes, technological disruptions, war, terrorism, transport issues, or other circumstances beyond the control of RatTech Solutions that prevent the execution of the agreement. In cases of non-compliance by a party, the agreement may be suspended or terminated without judicial intervention.
9. Guarantees and Liability
RatTech Solutions strives to achieve the best possible results but cannot guarantee specific outcomes. Liability is limited to the amount invoiced for the performed services and is further capped at the coverage provided by RatTech Solutions’ business insurance. Liability for damage to third parties or property is excluded.
10. Confidentiality
RatTech Solutions and its clients are committed to strict confidentiality regarding all confidential information obtained in the course of the agreement with RatTech Solutions. This obligation includes all data and information related to the operations of RatTech Solutions and its clients that can be considered confidential. RatTech Solutions and its clients will not disclose or use this information for any purpose other than the execution of the agreement. This confidentiality obligation remains in effect for three years after the termination of the agreement, unless otherwise agreed in writing.
11. Termination and Transfer
Cancellation of the agreement may incur costs. In case of non-compliance by either party, the agreement may be terminated. Transfer of obligations to a third party requires written consent from RatTech Solutions.
12. Competent Court and Applicable Law
Disputes will be submitted to the competent court, with Dutch law as the applicable law.
13. Rodent Control
RatTech Solutions addresses rodent issues without the use of rodenticides. The client is responsible for implementing the recommended exclusion measures.
14. Changes to the General Terms and Conditions
We reserve the right to amend the Terms and Conditions. Changes will be published on this website. We therefore advise you to review our Terms and Conditions regularly.
